Collection Notice

Loftex Pty Limited (Loftex) is collecting your personal information (including your name, contact details, demographic information and customer preferences) so that we can:

  • verify your identity;
  • contact you;
  • manage our relationship with you;
  • provide you with products, services or information in relation to a property; and
  • develop and improve our services and obtain feedback.

We will also use the contact information details you have provided to send you marketing information and materials related to our products, services and properties, including, where you have opted in, via email or other digital communications.
Loftex generally collects personal information directly from you, such as when you visit our website or otherwise contact and correspond with us (eg over the phone or in person). Where it is not practicable to collect personal information from you, we may also collect personal information from publicly available sources of information, and, where you have provided your consent, from third parties (such as selling agents).
If you do not provide us with the personal information we have requested, we may not be able to provide you with products, services and assistance to the extent that they require us to collect, use or disclose personal information.
Loftex may disclose your personal information to our related companies, contractors providing services to us and to other third party service providers (such as information technology providers and banks) we use in conducting our business.

Privacy Policy

Introduction

The Loftex website www.loftexproperty.com (Loftex Internet Site) is owned and controlled by Loftex Pty Limited (Loftex). This Privacy Policy is designed to tell you about Loftex’s practices regarding collection, storage, use and disclosure of personal information that Loftex collects via the Loftex Internet Site and through other methods. Where possible you should read this entire Privacy Policy (as well as the Loftex Internet Site Terms of Use) before using or submitting information to Loftex.

When dealing with personal information, Loftex, like other companies operating in the private sector in Australia, is bound by the Privacy Act 1988 (Cth) (including the Australian Privacy Principles).

What personal information do we collect?

The personal information that Loftex collects about you will to some extent depend on the personal information you provide to Loftex, as well as the nature of your relationship with Loftex.  The information Loftex may collect includes (but is not limited to) some or all of the following:

  • current address;
  • previous address;
  • telephone number;
  • mobile number;
  • date of birth;
  • occupation;
  • email address;
  • internet protocol address;
  • information about Loftex and Loftex’s projects and services that you have acquired, used or enquired about;
  • records of communications between Loftex and you; and
  • in the case of job applicants, education and employment history.

Why do we collect personal information about you?

Loftex collects personal information about you in order to provide personalised information and services to you.

The personal information you provide to Loftex will enhance the projects and services that Loftex offers you.

For job applicants, we will use your personal information to assess your application for employment with us.

If you do not provide Loftex with your personal information, Loftex may not be able to offer the projects or provide the services to you or to the level that Loftex would like to offer the projects or provide the services to you, and, in the case of job applicants, assess your application for employment.

How does Loftex collect your personal information?

Loftex collects your personal information in a number of ways:

  • directly from you (eg in person or over the phone), for instance when you inquire about a project or service, when we provide services to you, when you provide information to us in any form or when you submit your personal details through the Loftex Internet Site;
  • where you have provided your consent, from third parties, such as Loftex’s suppliers, agents or contractors;
  • from publicly available sources of information; and
  • from Loftex’s records of your interaction with Loftex through various media.

How does Loftex use your personal information?

Loftex respects your privacy and does not and will not, trade or sell your personal information. Loftex will use your personal information for the purpose for which it was collected. As already stated above, the principal reason Loftex collects your personal information is to provide personalised information and services to you. Accordingly, Loftex will use your personal information to:

  • verify your identity;
  • contact you;
  • respond to your queries;
  • assist you with your requests for information; and offer projects and provide services to you.

In the course of providing information or services to you, Loftex may also use your personal information for related purposes, which include the following:

  • understanding your property investment needs to provide you with better information, projects or services; and
  • conducting market analysis and sending you updated diverse property investment information.

Direct Marketing

Loftex may also use your personal information to inform you about other projects and services offered by Loftex from time to time, which may or may not be related to the specific project or services about which you have requested information.

Loftex may inform you about its other projects and services, together with Loftex’s marketing partners with whom Loftex shares its marketing and advertising activities or other companies that provide projects and services in conjunction with or on behalf of Loftex.  Loftex will not provide your personal information to these entities for the purpose of them contacting you about projects and services with which Loftex is not involved.

Loftex will inform you about services and projects through postal mail and telephone calls (even if you have registered your number with the Do Not Call Register) , and, where you have opted in, via email, SMS/text or other digital communications, or any other means of direct communication using the details you have provided to Loftex.

What if you do not wish to receive marketing information from Loftex?

Loftex’s aim is to provide the best projects and services to meet your needs and so would like to keep you up to date with all its projects and services it has on offer from time to time.

However, if you do not wish to receive marketing information from Loftex or be contacted by Loftex about its projects and services that do not relate to your enquiry, please contact us on 02 8920 0516 or Level 16, 61 Lavender Street, Milsons Point NSW 2061 Australia, and inform us that you do not wish to receive marketing information from Loftex.

Even if you have requested not to receive marketing information about services and projects that do not relate to your enquiry, Loftex will still contact you with important information on any of Loftex’s projects and services that you are currently using.

When and to whom will Loftex disclose your personal information?

Loftex may engage suppliers and contractors to deliver its projects and services to you. Loftex will disclose your personal information to those suppliers and contractors, only in relation to Loftex providing the projects and services to you. The services these suppliers and contractors provide to Loftex from time to time include, but are not limited to:

  • customer services;
  • mailing operations;
  • information technology services;
  • legal, accounting and financial services;
  • direct marketing and telemarketing services; and
  • market research and analysis.

Loftex makes every effort to ensure that any supplier or contractor to whom it discloses your personal information is bound by strict confidentiality and privacy obligations so that your personal information is protected.

Loftex may also disclose your personal information to our related companies or to your authorised representatives, including lawyers and accountants when requested by you.

Access to your personal information

You have the right to access and request correction of the personal information Loftex retains about you.

Before providing you with access to your personal information, Loftex will need to verify your identity.

Any requests to access personal information can be made by contacting our Customer Relations staff on 02 8920 0516 or Level 16, 61 Lavender Street, Milsons Point NSW 2061 Australia. Whilst most requests will be handled by one of Loftex’s trained staff members, there may be some requests which will need to be made in writing. The staff member who takes your call will be able to advise you on which requests will need to be made in writing.

If your request is complex, Loftex may need some time to address your request, which in most circumstances will be within 30 days of receiving your request.

There may be some situations where it is appropriate for Loftex to deny you access to your personal information for example for legal or security reasons. Loftex will provide you with reasons where it denies you access to your personal information.

Accuracy of your personal information

Loftex will take all reasonable steps to ensure that the personal information Loftex retains about you is accurate.

Loftex relies principally on the information you provide. Storage and security of your personal information

Loftex acknowledges its obligations to protect your privacy and personal information. Loftex will take reasonable steps to ensure that your personal information is stored in a secure environment to prevent any misuse, loss or unauthorised access, modification or disclosure. Loftex stores your personal information electronically via our IT systems, which may be located at our head office or in the cloud with a third party data storage provider.

Personal information provided online

Loftex has installed systems on the Loftex Internet Site to ensure that any personal information you provide online is secure.

Loftex may use Cookies on the Loftex Internet Site. Cookies are parcels of text that may be transferred from the Loftex Internet Site to your computer for record keeping purposes. Whilst cookies cannot confirm your identity or access your personal details, Loftex may use cookies to determine your interest in different parts of the Loftex Internet Site, by recording site preferences. If you do not want Loftex to track your online preferences, you can disable cookies on your computer.

Please be aware that although at times there may be links from the Loftex Internet Site to external websites, Loftex is not liable for the privacy practices, if any, of the companies that operate those external websites.

Complaints

If you have any enquiries in relation to the Privacy Policy or if you have a complaint about a possible breach of your privacy by us, please contact our Customer Relations staff on 02 8920 0516 or write to Loftex at:

We will investigate the complaint and determine whether a breach has occurred and what action, if any, to take. Loftex will take any privacy complaint seriously and will aim to resolve any such complaint in a timely and efficient manner, and our target response time is 30 days.

Loftex expects our procedures will deal fairly and promptly with your complaint. However, if you remain dissatisfied, you can also make a formal complaint with the Office of the Australian Information Commissioner.
